NON-IMMIGRANT

Unlike immigrant visas, non-immigrant visas do not open the door to permanent residence or naturalization processes.

 

But they can offer many other opportunities for foreigners interested in living, studying or working in the United States on a temporary basis.

Some of these visas can be renewed numerous times while others have limits. Additionally, this type of visa can help a foreign national remain legally in the United States while seeking a way to qualify for an immigrant visa.

 

The most common non-immigrant visas currently are:

  • Student Visas

  • Work Visas

  • Visas for Investors

Some non-immigrant visas require a sponsor. For these types of visas, the foreign professional depends on an employer to justify their hiring and thus work legally in the United States. The employer or sponsor is responsible for some of the steps necessary for visa approval, serving as a sponsor (hence the word sponsor) of the visa. In this way, the sponsor is responsible to the immigration authorities for the professional and must hire him or her for the position described in the visa application for the expected time and pay the salary presented to immigration or the Department of Labor, depending on the case or type of visa. .

 

The foreign professional can look for a sponsor while already being in the USA before requesting a change of visa, or while still being in another country going through the consular process to obtain the visa.

Below is a list of non-immigrant visas (or visas that do not lead to permanent residence) that require a sponsor or employment contract:

 

  • J-1 - This type of visa offers higher education students and/or foreign professionals entry into the USA to work in jobs previously authorized by the American government. Every year, hundreds of foreigners come to the United States to work in ski resorts, for example, through this program.

 

  • H-1B -  the H-1B visa targets professionals in various sectors and requires at least a completed higher education degree. 

 

  • H-2A and H-2B - for temporary jobs, this type of visa authorizes the entry of foreigners to work in positions where there is a lack of national labor, such as in the agriculture sector.

 

  • L-1A and L-1B - This type of visa authorizes employees or executives of multinationals to come to the United States to work in an affiliate or subsidiary in the national territory for a certain period of time.

 

  • O-1 - professionals with extraordinary talents in the scientific, artistic, educational, business, or sports fields can benefit from this type of visa. The foreign professional must demonstrate an enviable CV including national and foreign recognitions, certificates and titles, depending on the profile. In certain cases, the professional seeking this type of visa can ask their agent to serve as a sponsor.

 

  • P-1A, P1-B, P2, and P-3- this visa covers artists and entertainment professionals, such as athletes, professional players, and entertainment companies such as the circus.  

 

  • Q visas- participants in cultural exchange programs approved by the Department of National Security can enter the United States with this type of visa, which offers the opportunity for work and integration of foreigners into the local environment as well as interaction between nationals and professionals from other countries.

 

  • C-1, D, and C-1/D - This type of visa is used by employees who work on cruise ships and airline crews, for example.
