Family-Based Green Card

Kinship-based immigration is a process by which American citizens and permanent residents of the United States can sponsor the immigration of their immediate family members to the country. The objective of this type of immigration is to promote family reunification.

There are two main categories of kinship-based immigration visas in the US:

Immediate Immigrant Visa:

This category is reserved for the closest relatives of US citizens and has no annual visa limits.

 

Includes the following relationships:

  • Spouses of US citizens;

  • Unmarried children under the age of 21 of US citizens;

Parents of US citizens aged 21 and over.

Family Preference Visa:

  • This category is intended for more distant relatives of US citizens and permanent residents.

These visas have annual limits and are distributed into different preferences:

  • First Preference (F1): Unmarried children (over the age of 21) of US citizens;

Second Preference (F2):

  • F2A: Spouses and unmarried children under 21 of permanent residents;

  • F2B: Unmarried children (over the age of 21) of permanent residents;

  • Third Preference (F3): Married children of US citizens;

Fourth Preference (F4):

 

  • Brothers and sisters of U.S. citizens, as long as the U.S. citizen is at least 21 years of age.

The kinship-based immigration process generally involves several steps, including the immigrant petition filed by the U.S. citizen or lawful permanent resident, the processing of the petition by the U.S. Citizenship and Immigration Services (USCIS), obtaining an available visa number, the applying for an immigrant visa at the US Consulate or Embassy and undergoing medical examinations and interviews.
